Terms of Service

By creating an account, listing a card, sending a message, making an offer, or otherwise using nightmarket ("the app", "the service"), you agree to these terms.
1. The service
nightmarket is a peer-to-peer marketplace for collectible trading cards. We connect buyers and sellers who meet up in person to exchange cards. We are not a party to any transaction between users — all sales, trades, and meet-ups happen off-platform between you and the other user.
2. Eligibility
You must be at least 13 years old to use nightmarket. If you are between 13 and 17, you must have a parent or guardian's permission. We may require additional verification at any time.
3. Your account
You are responsible for activity on your account. Keep your phone number and login credentials secure. One account per person. Do not impersonate other users, businesses, or public figures.
We may suspend or terminate accounts that violate these terms or that we have reason to believe are inauthentic, abusive, or unsafe. Account suspension is at our sole discretion.
4. Listings — what you can post
You can list collectible trading cards (Pokémon, Magic, Yu-Gi-Oh!, One Piece, Dragon Ball, sports cards, and more) for sale, trade, or both. Each listing must:
- Accurately describe the card you're listing — its set, number, language, condition, and grading (if any)
- Show photos of the actual card you own (not stock images that misrepresent its condition)
- Use the card's correct language and printing variant — listing a Japanese card as English is misrepresentation
- Be priced honestly relative to your understanding of the card's market value
5. Prohibited content and behavior
You may not list, message, or otherwise post content that:
- Is illegal under U.S. or applicable state law — including but not limited to fraud, theft, sale of stolen goods, money laundering, or tax evasion
- Depicts child sexual abuse material (CSAM) of any kind. Verified CSAM is reported to the National Center for Missing & Exploited Children (NCMEC) and to law enforcement
- Is sexually explicit, pornographic, or sexualizes minors in any way
- Promotes violence, terrorism, hate speech, or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic
- Sells counterfeit, replica, or otherwise unauthorized cards marketed as authentic
- Sells stolen property — if a card was reported stolen and we receive a credible report, we remove the listing and may notify law enforcement
- Harasses, threatens, dox-es, or stalks another user via messages, listings, or any other surface
- Spams the marketplace with duplicate listings, bot-driven activity, or scraped/auto-generated content
- Misrepresents card identity, condition, language, grading, or set in a way intended to deceive
We use reactive moderation — user-submitted reports plus our own review — to enforce these rules. There is currently no automated content scanning at v1 scale; that will change as the marketplace grows and the volume justifies investment in proactive scanning systems (PhotoDNA, hash-matching, etc.). Until then, the responsibility to keep prohibited content off the platform sits with both you and the user community.
6. Reporting and enforcement
You can report any listing, message, thread, or user from inside the app. Reports are reviewed by the nightmarket team. Possible outcomes include:
- Dismissal — if the report doesn't reflect a violation
- Content removal — listing taken down; messages may be deleted
- User warning — first-strike or low-severity violation
- Account suspension or ban — repeated or severe violations
- Law enforcement referral — for illegal content (CSAM, threats, fraud)
We do not disclose to reporters whether a target was actioned, and we do not disclose to reported users who reported them. This is intentional — it protects reporters from retaliation and makes the marketplace safer.
For CSAM specifically: we report verified instances to NCMEC. Reporting is required by U.S. law (18 U.S.C. § 2258A) when we have actual knowledge.
7. Payments and meet-ups
nightmarket does not process payments. All money transfers happen off-platform between users (typically cash at meet-up). We are not a party to the transaction, do not hold funds in escrow, and do not facilitate refunds.
You meet other users at your own risk. Take normal precautions: meet in public spaces, daylight hours, with a friend if you can. We are not liable for outcomes of meet-ups arranged through the platform.
8. Trade signals and predictions
Some screens display AI-generated price predictions and trend signals. These are estimates based on public market data and may be wrong. They are not financial advice. Don't make purchase decisions you can't afford based solely on predictions in the app.
9. Content you upload
You retain ownership of photos and other content you upload. By uploading, you grant nightmarket a worldwide, non-exclusive, royalty-free license to display, store, and serve that content within the service. We do not sell your content or use it to train external models. We may use it for service operations (rendering listings, generating thumbnails, troubleshooting bugs, responding to legal process).
10. Privacy
We collect your phone number for verification (US numbers only at launch via Twilio), display name and avatar color you choose, listings and offers and messages you create, and basic device information for the app to function. We do not sell your personal information to third parties. See our Privacy Policy for the full breakdown of what we collect and how we use it.
11. Disclaimers
The service is provided "as is." We do not guarantee uptime, that listings will sell, that you'll find the card you want, or that other users are honest. We make reasonable efforts to keep the service running and the marketplace safe, but we make no warranty of any kind beyond what is required by law.
12. Limitation of liability
To the maximum extent permitted by law, nightmarket and its operators are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the service — including but not limited to losses from off-platform meet-ups, transactions, or interactions with other users.
13. Changes to these terms
We may update these terms as the service evolves. Material changes will be surfaced in the app. Continued use after a change means you agree to the updated terms.
